Introducing Earl Sharp, 2004 NCBC Chairman
NAHB’s National Commercial Builders Council (NCBC) is honored to welcome Earl Sharp of the Sharp Companies Inc. of Knoxville, Tennessee to serve as 2004 chairman. Sharp will be installed to his position at the 2004 International Builders Show, in Las Vegas, Nevada this January.
Sharp brings to the council nearly 40 years of experience in the construction industry. He started one of his first companies, Volunteer Drywall, back in June of 1964 after completing two years of active duty in the military police corp. He then started his construction company, Sharp Companies Inc., in 1969. “We have always been involved in residential and commercial construction, says Sharp. However, when the interest rates started going crazy in the late 1970’s, we gravitated more to commercial construction.”
With years of experience in commercial construction, and his continued involvement with NAHB, Sharp is guaranteed to bring a lot to the NCBC table. During Sharp’s term as chairman, his goal is to increase membership, boost the awareness of the talent and knowledge available to builder members, and have our members become more involved in other committees/councils of NAHB.
“Keep an open mind,” says Sharp when asked what advice he’d give other builders on how to expand their business. “Nothing is too difficult to undertake if you are willing to ask questions. Don’t try to reinvent the wheel. Commercial construction and remodeling is quick and profitable, just ask someone who is doing it.”

NAHB Forecasting a Strong Rebound for Commercial Construction
We are two years into the economic recovery, during which employment levels have steadily eroded and we are just beginning to see signs that employment growth may be around the corner.
Increases in employment will help put an end to several years of steadily rising office vacancy rates and will convince many consumers that the recovery really is underway.
Other commercial, which is primarily retail and service facilities and commercial warehouses, comprised about 56 percent of the $77 billion commercial construction put in place in the second quarter of 2003. Through the end of 2005 we expect the value of Other Commercial to increase but not at the pace of the other two components of commercial building, office, and hotel and motel. These two components, which did not weather the recession and recovery nearly as well as other commercial, will receive the benefit of a stronger rebound to growth.
Hotel and motel, and other commercial (retail and service facilities and commercial warehouses) have begun their expansion, figure 1. Our current forecast is that expansion will return to office construction in the second quarter of 2004. Expansion in the construction of office space is expected to usher in a period of growth for commercial construction as a whole through the remainder of our forecast period, which is through the fourth quarter of 2005.

US EPA sets enforcement of storm water permits as national priority
In the past few months it has become obvious that US EPA is following through with its strategy to make the enforcement of the Phase I and Phase II Storm Water Permits a national priority. Builders and developers from many parts of the country are reporting that EPA is inspecting sites and aggressively enforcing the conditions of the permit.
Any builder/developer that has a construction site that disturbs one or more acres of land and has storm water leaving the site must get a Phase I or Phase II Storm Water Permit. EPA’s Office of Enforcement and Compliance Assurance estimates that only about one-third of construction operators who should be seeking storm water permits are actually doing so. EPA believes that the lack of motivation to comply is due to a lack of field presence and enforcement response.
To address this lack of compliance, EPA has stated that it will focus on those developers that are responsible for the majority of the nation’s construction activities. Accordingly, EPA is targeting two categories of construction operations:
(1) commercial development of “big-box” stores and their associated developers, and
(2) large national and residential developers.
Builders/developers should be aware that to demonstrate compliance with the storm water permit regulations, the following must be done:
· Filing a Notice of Intent file prior to discharging storm water (the number of days between filing the Notice of Intent and being authorized to discharge storm water varies from state to state)
· Developing and implementing a Storm Water Pollution Prevention Plan (SWPPP) that addresses every facet of pollution prevention required in the SWPPP
· Conducting regular inspections, and
· Keeping accurate up-to-date records as required.
It cannot be emphasized enough that, for the most part, EPA judges compliance in terms of the SWPPP and the paperwork that supports it. As a result of a special program developed by EPA called the Expedited Settlement Offer Program, EPA has developed an inspection worksheet, which clearly shows what an inspector looks for during an inspection, and a spreadsheet that shows the penalty for each violation.
A copy of the Inspector Worksheet, called the “NPDES Industrial Storm Water Worksheet (Construction)” and the spreadsheet used to calculate the penalties, “Expedited Settlement Offer Worksheet—Findings and Alleged Violations”, are both available on NAHB.org. To locate these worksheets, do a “search” on NAHB.org for “EPA’s Enforcement,” which will bring up a link to a web page called “EPA’s Enforcement Policies and Programs” where you will find the information mentioned.

Find Staff Contacts with a Click of Your Mouse
NAHB’s new online Contact Directory on the NAHB Web site replaces the former print version. This directory, which includes both a Staff Directory and a Subject Directory, contains the names, telephone numbers, and e-mail addresses for all staff at NAHB. Available only to members, these directories are fully searchable and can be printed for easy reference.
The Subject Directory contains more than 700 keywords to help members identify the appropriate staff contact for a particular topic within seconds. Members can type in a topic, program, product, or service and the directory will automatically display the name, telephone number, and e-mail address for the appropriate contact.
The online Staff Directory makes it possible to look up staff by first name, last name, or department. These options are particularly helpful when you can’t remember a contact’s full name or want to see additional contacts within a department.
Members can access either directory by visiting www.nahb.org and clicking the NAHB Contact Directories link under Contact Us. You must log into www.nahb.org to access the directories.
