  Austin HBA Fights Fire Sprinkler Mandate

In its history of fire sprinkler mandates challenges, the Home Builders Association (HBA) of Greater Austin has traditionally sparred with city governments.  The most recent showdown, however, occurred between the HBA and Travis County Emergency Services District (ESD) #3 when the ESD moved to mandate residential fire sprinklers.

In Texas, an ESD is a geographic area supported by taxes to provide emergency services within that area.  It is governed by a county-appointed commission. ESDs were created to improve rural fire protection areas and to build a partnership with municipalities to ensure adequate service delivery is provided.

Texas has 261 ESDs. A fire sprinkler mandate in residential homes in the Travis County ESD case is precendent setting.

The HBA of Greater Austin tapped the NAHB Research Center  for data to reinforce their position against mandates, with great success.  On January 28, the ESD board voted unanimously to adopt a “mandatory option” standard.  This translates to a mandatory requirement that fire sprinkler systems be offered as an OPTION to the home buyer.  At the time the building permit is obtained, the owner will submit a waiver (if the owner opts out) to refuse the systems.  There is no administration of costs and if the home is a spec it will be accepted or waived by the builder. The District will provide the promotional material to be provided to potential buyers.

In addition to this case, the HBA of Greater Austin also experienced a win in the City of Cedar Park.
