Builders in Nearly a Quarter of U.S. States Have Notice and Opportunity to Repair Option

Nine States Enact Laws in 2003; Others likely to follow

The notice and opportunity to repair movement, which started last year in Washington, Arizona and California, has made significant progress in 2003.

Legislation giving builders the opportunity to repair damages before being sued has been signed by governors in nine states: Colorado, Florida, Idaho, Indiana, Kansas, Kentucky, Montana, Nevada and West Virginia. In Alaska and South Carolina, legislation is awaiting the governors’ signatures, and bills are still active in Illinois, Missouri, Ohio and Oregon.
